Owner App License (EULA)

Last updated: October 2026

1. Scope

This End User License Agreement ("EULA") governs the use of the ORDUMI Owner App — the application that business owners and their authorised staff use to receive and manage orders, reservations, notifications and related business operations ("Owner App", "App"). The Owner App is provided by ORDUMI Digital Solutions, Owner: Leon Klautsch, Hauptstr. 27, 99988 Heyerode, Germany ("ORDUMI", "we").

The Owner App is a companion tool for the ORDUMI platform. The subscription and service terms between ORDUMI and the business customer are governed by our Terms of Service (AGB); this EULA covers only the licence to use the App itself. If the App is obtained from the Apple App Store or Google Play, the applicable platform's standard licence terms also apply alongside this EULA.

2. Licence grant

ORDUMI grants the business customer a non-exclusive, non-transferable, revocable licence to install and use the Owner App, for the duration of a valid ORDUMI subscription, solely for operating the Customer's own business location(s) connected to its ORDUMI account. The licence may be used by the Customer and its authorised staff; it may not be shared with third parties outside the Customer's business.

3. Permitted use

  • Use the App only for the Customer's own business, via the Customer's own ORDUMI account.
  • Keep login credentials and devices secure and assign each staff member their own access where available.
  • Comply with all applicable laws, including data protection, food safety and consumer protection law, when processing orders and guest data in the App.

4. Restrictions

  • Do not copy, modify, adapt, translate or create derivative works of the App.
  • Do not reverse engineer, decompile or disassemble the App, except where this is expressly permitted by mandatory law (§§ 69d, 69e UrhG).
  • Do not rent, lease, lend, sublicense, resell or commercially exploit the App or make it available to unauthorised third parties.
  • Do not use the App to operate, replicate or provide a competing service, or to circumvent the limits and entitlements of the Customer's ORDUMI plan.
  • Do not interfere with or disrupt the App, its security features or the underlying ORDUMI services.

5. Updates and availability

We may release updates, new versions or new features for the App. Updates may be required to continue using the App with the ORDUMI platform. We do not guarantee that older versions will remain functional. Availability of the App depends on the Customer's device, operating system version and internet connection; we do not guarantee uninterrupted operation.

6. Intellectual property

All rights, title and interest in the App — including software, design, brand names and documentation — remain with ORDUMI. This EULA is a licence, not a sale: the Customer does not acquire any ownership rights in the App. The Customer retains all rights to its own business data processed through the App.

7. Third-party services and content

The App displays and processes content and services of the Customer and third parties (e.g. order data from end customers, payment status from the Customer's payment provider). ORDUMI is not responsible for the content of the Customer's business data or for third-party services. Payments from end customers are processed through the Customer's own payment provider account; ORDUMI never receives or holds these funds.

8. Warranty and liability

The App is provided "as is" within the scope permitted by law. Mandatory statutory warranty rights remain unaffected. ORDUMI's liability follows the limitations set out in our Terms of Service (AGB), section "Limitation of liability": unlimited for intent and gross negligence, for injury to life, body or health and under the Product Liability Act; otherwise limited to foreseeable, contract-typical damage and in any case to the fees paid in the 12 months before the damaging event.

9. Term and termination

The licence ends automatically when the ORDUMI subscription of the Customer ends or is terminated, or when ORDUMI terminates the licence for good cause (in particular serious breaches of this EULA). Upon termination, the Customer shall stop using the App and delete it from its devices. The Customer's data remains subject to the retention and export rules in our Terms of Service and Privacy Policy.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should any provision of this EULA be invalid, the validity of the remaining provisions is not affected. Questions about this EULA: info@ordumi.com.
